今回は2024年3月31日よりスタートした、デジタルノマドについてご案内いたします。
デジタルノマドとは、リモートワーク等を目的として日本で滞在するために付与される在留資格（VISA）のことです。
これまでは、短期滞在で来日される方が多かったと思いますが、この度このような制度が新しくできました。
特定活動（告示５３号）（デジタルノマド）の在留資格に該当する活動をご紹介します。
①本邦において６月を超えない期間滞在して国際的なリモートワーク等を行う者である場合
②外国の法令に準拠して設立された法人その他の外国の団体との雇用契約に基づいて、本邦において情報通信技術を用いて当該団体の外国にある事業所における業務に従事する活動
③外国にある者に対し、情報通信技術を用いて役務を有償で提供し、若しくは物品等を販売等する活動
以下、少し解説を致します。
まず、外国の団体との雇用契約に基づくということですので、日本国内の企業に就職等される方は対象とされません。
また、②と③のどちらか該当していれば大丈夫です。
③の場合、本邦に入国しなければ提供又は販売等できないものを除かれます。
なお、資格外活動許可は原則認めらず。日本の公私の機関との雇用契約等に基づく就労活動をすることはできません。
以上が、デジタルノマドの活動内容となります。

This time, I will talk about a VISA for DIGITAL NOMAD that came into effect March 31st this year.
Q: What is DIGITAL NOMAD??
A: DIGITAL NOMAD is a VISA for people who stay Japan and work remotely from Japan.
Before DIGITAL NOMAD came into effect, those people who do work remotely had come to Japan with SHORT-TERM VISA. But now, you can come to Japan with this DIGITAL NOMAD VISA.
Q: Who is applicable for DIGITAL NOMAD??
A:People who meets the requirements as follows (①and②or③).
①Individuals wishing to work remotely in Japan for a period not exceeding six months.
②IActivities based on an employment contract with a corporation or other foreign organization established in accordance with the laws and regulations of a foreign country to engage in business activities using information and communication technology in Japan at the business office of said organization located in a foreign country.
③Activities to provide services for a fee or sell goods, etc. to a person in a foreign country using information and communication technology
I will explain details.
First of all, “based on an employment contract with a corporation or other foreign organization” means those who are employed by companies in Japan are not eligible for this VISA.
In principle, permission to engage in activities other than permitted under the status of residence is not allowed, so you may not engage in employment activities based on employment contracts or other contracts with public or private organizations in Japan.
